Terms of Service

These Terms of Service ("Terms") govern your use of The Talking Game website, the waitlist, and our mobile app for iOS and Android (together, the "Service"), provided by The Talking Game ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Who can use the Service

The Talking Game is intended for adults. You must be at least 18 years old, or the age of majority where you live, to use the Service. The questions are written for close friends and can be candid; you are responsible for choosing an appropriate intensity for your group.

The waitlist

Joining the waitlist means we may email you about early access and launch. Being on the waitlist does not guarantee access at any particular time and creates no obligation to purchase anything. You can unsubscribe at any time.

No account required

You can play The Talking Game without creating an account. Players, characters, and game progress are stored on your device. You are responsible for the device you use and for the people you choose to play with.

Purchases, packs, and the subscription

• Free starter pack. The Service includes a free pack (First Light) so you can experience the core of the game at no cost.
• One-time packs — own forever. Additional question packs are available as one-time purchases (for example, $4.99 each). When you buy a pack, you own it forever; it is not a recurring charge.
• Optional subscription. An optional All-Access subscription (for example, $10.99/month) unlocks every current pack and all future packs for as long as the subscription is active. The subscription is entirely optional — owning individual packs never requires a subscription.
• Billing through the app stores.All purchases are processed by Apple's App Store or Google Play under their terms. Subscriptions renew automatically until cancelled, and you manage or cancel them in your App Store or Google Play account.
• Restore purchases. You can restore packs you own on any device signed in to the same App Store or Google Play account. No account with us is needed.
• Refunds. Refunds are handled by Apple and Google according to their policies. We do not separately process payments and cannot issue store refunds directly.

Acceptable use

You agree not to:

• Reverse engineer, copy, resell, or redistribute the Service or its content.
• Use the Service to harass, harm, or violate the rights of others.
• Interfere with or disrupt the Service, or attempt to bypass purchase or access controls.
• Use the Service in violation of any applicable law.

Our content and intellectual property

The Service, including the questions, packs, characters, design, and software, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, limited, non-transferable, non-exclusive license to use the Service and the content you have unlocked, for your own personal, non-commercial enjoyment. All rights not expressly granted are reserved.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. The questions are prompts for conversation and are not professional, legal, medical, or psychological advice.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

Changes to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms; when we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Termination

We may suspend or terminate your access to the Service if you violate these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

Governing law

These Terms are governed by the laws applicable where we are established, without regard to conflict-of-laws principles. Nothing in these Terms limits any consumer-protection rights you may have under the mandatory laws of your country of residence.
